Terms of Service

These Terms of Service ("Terms") are between you and Find You Media Corporation, a Canadian corporation ("Find You Media," "we," "us," or "our"), operating P/LATFRM® AI ("P/LATFRM®," "Platform," or "Service").
1. ACCEPTANCE OF TERMS
By accessing or using P/LATFRM®, you agree to these Terms. If you disagree with any part, do not use our Service.
2. OUR SOFTWARE STACK
We run on world-class leading software and combine our stack to make a one-stop login for all the tools—from hosting your site, running your AI agents, viewing your CRM, and managing your team, as well as invoicing, contracts, and even running ads and managing your social media.
Having a unified experience saves you well over $1,500 in platform fees. This time with the "O," replacing them with one login with P/LATFRM AI. Oh yeah, that's right, we said it! If you want to know more, we can talk to you about that on a discovery call or onboarding. It's a little bit of our secret sauce, but we're open to sharing on a discovery call.
3. SERVICES PROVIDED
We provide:
- Website building and hosting services
- AI-powered communication tools (voice, SMS, email)
- CRM and business automation tools
- Training and support for platform usage
- Custom implementation services
4. LIFETIME HOSTING TERMS
"Lifetime" hosting means for the operational lifetime of P/LATFRM® as a service, not your personal lifetime or eternity. If P/LATFRM® ceases operations:
- We will provide 90 days notice when possible
- You will receive a complete export of your data
- We will assist in migration to another platform
- No refunds will be provided for lifetime purchases
5. PAYMENT TERMS
- Lifetime Plans: One-time payment, non-refundable except as specified
- Monthly Plans: Recurring billing, cancel anytime
- Usage Fees: Billed monthly for actual usage (calls, texts, emails)
- All prices in USD unless specified
- Canadian customers may use promotional codes when available
6. REFUND POLICY
Refunds are LIMITED and DISCRETIONARY:
ELIGIBLE for consideration:
- Complete non-delivery of services within 30 days
- Technical inability to provide core services
- Billing errors
NOT ELIGIBLE for refunds:
- Change of mind after work has begun
- Dislike of design after approval
- Business closure or change
- Inability to use features due to user error
- Partial completion of services
For "Done With You" plans: No refunds after training begins.
For "Done For You" plans: Partial refunds at our sole discretion if we cannot deliver basic functionality.
7. AI COMMUNICATION & A2P 10DLC COMPLIANCE
To maintain network integrity and comply with telecommunication laws, strict compliance is enforced across all communication channels.
SMS & A2P 10DLC MESSAGING:
- A2P 10DLC Registration: All businesses must be registered for A2P 10DLC compliance before sending SMS traffic. We facilitate this process, but you are responsible for providing accurate and verifiable business details.
- Prior Express Consent: You must obtain explicit, documented consent (opt-in) before sending any SMS messages. Opt-in data cannot be bought, shared, or assumed.
- Opt-Out Mechanisms: Every campaign must honor standard opt-out keywords (STOP, UNSUBSCRIBE, CANCEL) immediately. You must provide clear opt-out instructions in your messaging.
- Prohibited Content (SHAFT): No content related to Sex, Hate, Alcohol, Firearms, or Tobacco is permitted. Additionally, high-risk financial services, CBD/Cannabis, and deceptive marketing are strictly prohibited. Violations will result in immediate carrier blocking and account suspension.
- Sender Responsibility: You are solely responsible for ensuring your message content complies with all applicable local and federal laws (including TCPA).
VOICE AI:
- All AI calls must clearly identify themselves as AI or automated at the beginning of the call.
- Calls must comply strictly with TCPA regulations.
- You must have explicit consent for outbound promotional calls.
- You are required to maintain and respect Do Not Call (DNC) lists.
EMAIL:
- CAN-SPAM Act compliance is strictly required.
- All marketing emails must include clear, working unsubscribe options.
- No misleading subject lines or falsified sender information.
8. ACCEPTABLE USE POLICY
You may NOT use P/LATFRM® for:
- Illegal activities
- Spam or unsolicited communications
- Harassment or abuse
- Intellectual property infringement
- Malware or malicious code distribution
- Adult content (unless legal and with strict age restrictions)
- Regulated industries without proper compliance (gambling, cannabis, etc.)
9. SERVICE LEVEL & SUPPORT
- "Lifetime" support means reasonable assistance via email/chat
- No guaranteed response times for lifetime plans
- Priority support available for an additional fee
- We fix platform breaks, not user-created issues
- Custom work beyond initial setup incurs additional charges
10. INTELLECTUAL PROPERTY
- You own your content
- We own the platform and any custom code we create
- You grant us a license to display your site and use it for service provision
- Templates and platform features remain our property
11. DATA OWNERSHIP & PORTABILITY
- You own all customer data
- You can export your data at any time
- We retain rights to aggregated, anonymized data
- Upon termination, data is available for 30 days
12. LIMITATION OF LIABILITY
Our total liability shall not exceed the amount you paid us in the last 12 months. We are not liable for:
- Lost profits or revenue
- Loss of data (you must maintain backups)
- Indirect or consequential damages
- Third-party service failures (including our infrastructure provider)
13. INDEMNIFICATION
You indemnify us against claims arising from:
- Your use of the service
- Your content
- Your violation of laws or regulations
- Your communications sent through our platform
14. TERMINATION
We may terminate for:
- Violation of these terms
- Non-payment
- Illegal activity
- Excessive resource usage
- Abuse of staff or systems
15. MODIFICATIONS
We may modify these Terms with 30 days notice via email. Continued use constitutes acceptance.
16. DISPUTE RESOLUTION
Disputes will be resolved through binding arbitration in British Columbia, Canada, except for small claims court matters.
17. GOVERNING LAW
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein.
